1. Overview
This page describes how residents of United States states with comprehensive privacy laws can exercise their rights with Azul Performance, LLC, including the right to opt out of the sale or sharing of personal information and of targeted advertising.
We do not operate a request form on this website. Requests are handled through a monitored inbox so that a person reviews each one. That is slower than a widget and considerably more reliable.
2. What “sale” and “sharing” mean here
Under several state privacy laws, “sale” is defined broadly enough to include disclosing personal information to a third party in exchange for monetary or other valuable consideration, regardless of whether money changes hands and regardless of whether the individual asked for the disclosure.
Azul Performance delivers consumer inquiries to advertisers that a consumer has asked to hear from, and receives consideration for doing so. Depending on the state and the interpretation applied, that activity may be treated as a sale or as sharing for cross-context behavioural advertising.
Rather than argue the point, we provide an opt-out route to everyone who asks.
2.1 What we do not do
- We do not operate a general data brokerage or sell contact lists.
- We do not sell or share the personal information of individuals we know to be under sixteen.
- We do not use sensitive personal information for purposes that carry a right to limit under California regulations.
3. Rights available
Depending on your state of residence you may have the right to:
- Know what personal information we have collected about you, the sources, the purposes and the categories of recipients.
- Access a copy of that information, in a portable format where required.
- Correct inaccurate personal information.
- Delete personal information, subject to statutory exceptions such as records we must keep to evidence a prior consent or to comply with law.
- Opt out of sale, sharing and targeted advertising.
- Limit the use and disclosure of sensitive personal information.
- Appeal a decision we make, where your state provides an appeal right.
- Not be discriminated against for exercising any of these rights.
3.1 Suppression is separate and always available
Independently of state law, any consumer can ask to be suppressed from contact in connection with an inquiry submitted through our network. Suppression is applied network-wide rather than to a single campaign, and we act on it whether or not a statutory right applies.
4. How to submit a request
4.1 By email
Send a message to privacy@azulperformance.com with “Privacy Request” in the subject line. Please include:
- the right you wish to exercise (know, access, correct, delete, opt out, limit or appeal);
- the state in which you reside;
- the email address and telephone number you believe are associated with the information, so that we can locate it;
- whether you are submitting on your own behalf or as an authorized agent.
4.2 By opt-out preference signal
Where required by applicable law, we honour recognised browser signals such as Global Privacy Control. A recognised signal is treated as an opt-out request for the browser transmitting it. Because a browser signal is not tied to an identified person, it cannot by itself action a request relating to information already held.
5. Verification and timing
5.1 Verification
We must take reasonable steps to confirm that a request comes from the individual it concerns, or from someone authorised to act for them. Verification is proportionate to the sensitivity of the information involved. We will ask only for what is necessary, and information supplied for verification is used for no other purpose and is deleted afterwards.
Where we cannot verify identity, we will explain why and, where possible, tell you what would allow us to proceed. An unverifiable deletion request may still be treated as an opt-out request where the applicable law allows.
5.2 Authorized agents
An agent may act on your behalf with written permission signed by you, or with a valid power of attorney. We may contact you directly to confirm the authorisation and to verify your identity.
5.3 Timing
We acknowledge requests promptly and respond within the period required by the applicable statute, generally forty-five days from receipt, with one extension where permitted and where we notify you of the reason and the expected timeframe.
5.4 Cost
There is no charge for a request. Where a request is manifestly unfounded or excessive, particularly because it is repetitive, we may decline it and will explain why.
6. Appeals
If we decline a request in whole or in part, our response will explain the reason. Residents of states that provide an appeal right may appeal by replying to our response or by writing to compliance@azulperformance.com with “Privacy Appeal” in the subject line.
Appeals are reviewed by someone who was not involved in the original decision. We respond within the statutory period and, if the appeal is denied, we will tell you how to contact your state attorney general.
7. Requests relating to an advertiser
Once a consumer inquiry has been delivered to an advertiser, that business becomes an independent controller of the information it received and applies its own privacy notice and retention rules.
We can tell you the categories of recipients and, where we hold the information, help you identify who received an inquiry, so that you can direct a request to them as well. We cannot delete information from a third party's systems on your behalf, but we will not obstruct a request you make to them.
Suppression on our side prevents further delivery. It does not undo a delivery that has already occurred.
